Major US Internet providers—including AT&T, Verizon, Comcast, Cablevision, and Time Warner Cable—have just signed on to a voluntary agreement with the movie and music businesses to crack down on online copyright infringers. But they will protect subscriber privacy and they won't filter or monitor their own networks for infringement. And after the sixth "strike," you won't necessarily be "out."<br /><br />Much of the scheme mirrors what ISPs do now. Copyright holders will scan the 'Net for infringement, grabbing suspect IP addresses from peer-to-peer file-sharing networks. If they see your IP address participating in a swarm for, say, Transformers, they will look up that IP address to see which ISP controls it, then fire off a message.<br /><br />ISPs have committed to forward such notices to subscribers—though, crucially, they won't turn over actual subscriber names or addresses without a court order. This is a one-way notification process.<br /><br />The agreement puts heavy emphasis on "education," going so far as to recast this behavior as some "right to know" on the part of parents unaware of a child's P2P activity. According to today's announcement materials, the goal is to "educate and stop the alleged content theft in question, not to punish. No ISP wants to lose a customer or see a customer face legal trouble based on a misunderstanding, so the alert system provides every opportunity to set the record straight."<br /><br />It would be much easier to see "education" focus as a principled stand by content owners if they hadn't spent years suing such end users, securing absurd multi-million dollar judgments in cases that they are still pursuing in court. As it is, the shift looks more like a pragmatic attempt to solve a real problem through less aggressive measures after the failure of scorched earth tactics.<br /><a name='more'></a>In addition, the ISPs were never going to go along with draconian penalties imposed on their own paying customers. The end result, then, is actually a fairly sensible system arrived at years too late, after infringement has already begun its shift away from easily-monitored P2P networks to HTTP streaming and one-click download services which can't be so easily monitored by third parties.<br /><br />The result is "copyright alerts," a series of messages warning users that their (alleged) activity has been detected and that penalties could result if it continues. These notes continue repeatedly—two, three, even four warnings likely won't result in any penalties—but the scheme certainly does have a punitive component.<br /><br />ISPs have agreed to institute "mitigation measures" (or, as you and I know them, punishments) based on the collected say-so of copyright holders. These measures begin with the fifth or six alert, and they may include "temporary reductions of Internet speeds, redirection to a landing page until the subscriber contacts the ISP to discuss the matter or reviews and responds to some educational information about copyright, or other measures that the ISP may deem necessary to help resolve the matter."<br /><br />There is no requirement that ISPs disconnect a user's Internet connection at any point, and indeed ISPs say they will refuse any measure that might cut off a user's phone service, e-mail access, "or any security or health service (such as home security or medical monitoring)." But ISPs are free to disconnect users if they wish (as indeed they have always been).<br /><br />As such approaches go, this one sounds fairly sane, and ISPs certainly claim the rights to take such actions in their terms of service. The stated goal is to provide enough "education" that the punishment stick can stay in the shed, but there's no avoiding the fact that the "mitigation measures" are the result of private, unverified accusations not vetted by a judiciary. Depending on your view of Internet access—is it a human right as some in the UN think?—such private countermeasures on infringement may look problematic. (The French courts also demanded that any tough measures by ISPs come only after judicial scrutiny, though their system is actually administered by the government; this one, run voluntarily, is not.)<br /><br />An appeals process does at least exist. Before a "mitigation measure" is taken, users can request an independent review of the accusation, but not from a judge; it remains unclear who exactly will handle the appeal. To keep everyone from using the system every time, there's a $35 filing fee (which can be waived by the independent reviewer). In addition, subscribers can always still sue their ISP in court.<br />Baby steps to mitigation<br /><br />The complete list of "alert" steps is included below for your reading pleasure:<br /><br />First Alert: In response to a notice from a copyright owner, an ISP will send an online alert to a subscriber, such as an email, notifying the subscriber that his/her account may have been misused for content theft, that content theft is illegal and a violation of published policies, and that consequences could result from any such conduct. This first alert will also direct the subscriber to educational resources which will (i) help him/her to check the security of his/her computer and any Wifi network, (ii) provide explanatory steps which will help to avoid content theft in the future and (iii) provide information about the abundant sources of lawful music, film and TV content.<br /><br />Second Alert: If the alleged activity persists despite the receipt of the first alert, the subscriber may get a second similar alert that will underscore the educational messages, or the ISP may in its discretion proceed to the next alert.<br /><br />Third Alert: If the subscribers account again appears to have been used for content theft, he/she will receive another alert, much like the initial alerts. However, this alert will provide a conspicuous mechanism (a click-through pop-up notice, landing page, or similar mechanism) asking the subscriber to acknowledge receipt of this alert. This is designed to ensure that the subscriber is aware of the third copyright alert and reminds the subscriber that content theft conducted through their account could lead to consequences under the law and published policies.<br /><br />Fourth Alert: If the subscribers account again appears to have been used for content theft, the subscriber will receive yet another alert that again requires the subscriber to acknowledge receipt.<br /><br />Fifth Alert: If the subscribers account again appears to have been used for content theft, the ISP will send yet another alert. At this time, the ISP may take one of several steps, specified in its published policies, reasonably calculated to stop future content theft. These steps, referred to as Mitigation Measures, may include, for example: temporary reductions of Internet speeds, redirection to a landing page until the subscriber contacts the ISP to discuss the matter or reviews and responds to some educational information about copyright, or other measures that the ISP may deem necessary to help resolve the matter. ISPs are not obligated to impose any Mitigation Measure which would disable or be reasonably likely to disable the subscribers voice telephone service (including the ability to call 911), e-mail account, or any security or health service (such as home security or medical monitoring). I personally don't see what all the hub-ub is all about. There is only a few new features being added such as a dual-camera, duel-core A5 chips, and dual-view HDMI. All though it will have iOS 4.3 I don't see why they would really need it besides maybe the iMovie program or whatever. (Yeah, I'm not much of an Apple fan). It seems like a waste with the iOS 4.3 since <i>everything</i> is pretty much locked-down with Apple's crazy restrictions on absolutely everything they make. </div><div style="text-align: left;"><br /></div><div style="text-align: left;"> In my personal opinion, I would sit this one out guys. For the price they are charging and for what features should have been out on the first iPad, I suggest just waiting, but if you're a hipster and live in a coffee shop and like to throw money at Apple, go for it. This week on Free Stuff Fridays I am giving out a list of great programs that are used for troubleshooting computers and all can be ran off your USB device, and most of all; they are all FREE!<br /><br /><ul><li><u>Device Doctor Portable</u></li></ul> Great USB tool that can easily scan your computer to find if your, or someone else, computer needs to have their drivers updated. I don't know how many times I use the windows driver updater and it just tells me I have the latest drivers. Another great thing about this is that it finds the correct driver for you to download and provides a link.<br /> Download link: <a href="http://adf.ly/UlPj">Here</a> <br /><br /><ul><li><u>Speccy</u></li></ul> Another cool tool that when ran scans your computer specs and comes with a very slick looking user interface that can tell you everything hardware related to your computer. Run the program, select the settings for the dead pixels like size and length of time you want it to run, the longer the better, but don't over do it. I was oblivious of speed painting and, frankly, didn't even know it was possible to paint Einstein upside down in under five minutes. Yes you read that correct, five flippin' minutes. The show I got to go to was about an hour and he painted Lil Wayne, Lady Gaga, Martin Luther King Jr., and Einstein. It was an amazing coordination of both skill and talent that involved multiple up beat mixed songs that went along to him painting. I can just say I was pretty much stunned after seeing him put some scribbles onto the black canvas then seconds later making out a beautiful piece of art.</div><div style="text-align: left;"> Much respect to artists such as David, he has truly inspired me to become much more artistic with my life, I never even thought it could be some much fun to coordinate dancing into something such as painting. As the game starts out, you are brutally "murdered" by a cheeky fellow in a checkered suit with a pretty pearl .45. You wake up in a rundown town called Goodspring in their doctors house. (Yeah you weren't "murdered" but you were shot in the face). There are many mysteries and side quests that the player may complete as their leisure. They can run through the campaign or take their time doing every stinking side quest. You can literally spend DAYS playing this game, I know I have already clocked in over a week or two of play time. The game is about the same if you have played the first Fallout. You also don't need to have played the first Fallout to understand the story of this Fallout game, all though I think you should play it in my opinion. The story in that one is a wee bit better in my eyes.</div><div style="text-align: left;"><br /></div><div style="text-align: left;">Playability, the one world that should be present in any game ever created. You know why all those other crappy games went down onto the this game sucks big mansticks is because of playability. Call of Duty is such a <i>good </i>game because people can keep replaying it. The exact same thing with this game, you can first play as a good character, then replay as a bad character or a neutral character. Wipe out one faction save the other. </div><ul><li><span style="background-color: lime;">Protip</span>: Get a companion as fast as you can and carry anything of value, i.e. guns, armor, meds/drugs, or any other miscellaneous items you may find on your travels. You can really use those caps fast when you <span style="background-color: red;">*SPOILER*</span> buy lots of body implants that can greatly increase your stats. Each costs about 4K caps and the better ones can cost up to 8Kcaps! A good place to sell your crap is at the Gun Runners west of New Vegas, later on in the game they hold a fluffy 8K caps for you to sell stuff to.</li></ul> <u>Hardmode</u>: A motherless baby in need of a boob to suckle on, my god! Only play on hardmode if you have played the entire game, know what you are doing, and are brave enough to take on the mundane annoying ass tasks that hardmode requires. Constantly tired come on you wimp! Keep walking and shooting! Thirsty? Suck it up bitch, you think the military was thirsty at the Palau islands? Shit yeah they were, but we still kicked ass!<br /><br />Summary of my rant, the game is definitely a buy. The game has good mechanics, re-playability, thrill, story, and deep characterization. Awwww yeah! The Samsung Captivate smartphone. This thing has got <span style="color: red;">balls of steel</span> baby, best phone I have ever had in my entire life and with a little insight and trickery you can get around the crazy amount of charges that AT&T wants you to pay monthly.<br /><br />GO-PHONE! I can't stress this enough for a smartphone if you rarely use a data plan. I am not an avid Facebooker or a ... Twitterer. (I usually only check my email when I get home anyways) So I was in no need for a $15 monthly fee for data I was never gonna use. I got a go-phone and as a college student I rarely use the phone feature too, mainly just for texting my peeps. Easy ass plan let me tell you. Works wonders, got the $1/day usage fee IF you use the phone that day then some other charges every minutes after, I don't know them since I don't use them. Then get the 1000 text message package for like $10. Boom, I spend just about $20 a month on a top of the line smartphone.<br /><br />Now beyond my rant about my service provider and onto the phone! The phone is flippin' light! I compared it to the Droid and let me tell you, the Droid is like holding a brick while the Captivate is like holding a feather. I just bought a case on eBay for $5 to keep it from floating away. The screen is also very bright and the OS as a whole is very responsive. I enjoy the fact that it uses the Android OS since I think Apple is a bunch of pretentious buttfucks that duct tape everything they can down to keep you from doing something they don't want you to do. Android removes that tape with open source baby. Talk about an awesome OS, opensource, fast, light, and the app marketplace is already getting close to that of Apples. <br /><br /><ul><li><span style="background-color: lime;">Protip:</span> Turn the screen brightness down all the way, even if you don't have the Captivate. Keeping the brightness low may make it harder to see, but trust me you'll get used to it. The battery lasts an additional day or two with the brightness down to low.</li></ul><ul><li><span style="background-color: lime;">Protip:</span> Turn off 3G if you aren't using a data plan like me, to do it on the captivate. Dial "*#*#4636#*#*" that should bring you into the phones maintenance mode, click phone information, and change it to GSM only. Boom, no more 3G charges up the ying-yang. </li></ul><br />From just following those tips, my phone only needs to be charged about once a week, and I use it EVERY day. Amazing!<br /><br />In summary, best phone I have ever had in my entire life.
